Who We Are

In these Terms and Conditions, “us,” “we,” and “our” refer to Vikings Sailing Club, registered as VO1890 with the Malta Council for Voluntary Sector. “You” and “your” refer to the user, member, or participant engaging with our services or using this website.

Governance and Jurisdiction

These Terms and Conditions are governed by the laws of Malta. By registering for a course or using this website, you consent to the jurisdiction of the Maltese courts to settle any disputes that may arise.

Registration and Payments

1. Parents or legal guardians must register students under 18 years and are responsible for all applicable fees, including tuition and registration.
2. Payments for a term are non-transferable except in special cases like severe illness.
3. Payments are non-refundable if a student misses a session for any reason.
4. Payments cannot be transferred to cover other bills or fees owed by other students.
5. Term fees offer reduced rates, accounting for potential missed sessions. Pro-rata payments for partial attendance are not permitted.
6. If a term has already started, individual session fees apply and must be booked via the website in advance.

Course Scheduling and Cancellations

1. No replacements will be offered for any missed sessions by the student.
2. If the club cancels a session, it will be rescheduled to a later date.
3. Land-based sessions may be conducted if adverse weather conditions make sailing unsafe.

Health and Safety

1. Sailors are aware of and accept the physical challenges and risks associated with sailing.
2. Participation is at the individual’s own risk, and compliance with safety instructions is mandatory.
3. Wearing flotation devices during all sailing sessions is compulsory.
4. Any existing medical conditions must be disclosed during booking.
5. Participants consent to basic First Aid being administered where necessary.

Intellectual Property

1. All proprietary content, trademarks, or service marks displayed on this website are owned by Vikings Sailing Club and may not be used without our prior written consent.

Limitation of Liability

1. Neither Vikings Sailing Club nor any of its members, volunteers or committee members shall be held responsible for personal injury, death, or damage to third-party property.
2. The club’s maximum liability for any claims arising from these terms shall not exceed the amount of the order in question.

Indemnification of Club Representatives

1. Individuals acting in the capacity of managers, employees, or directors for Vikings Sailing Club are not personally liable for any actions or omissions while executing duties on behalf of the club, provided they act in compliance with the law and in good faith. No such individual shall be personally responsible for any litigation, claims, or damages arising from the operation or actions of the Vikings Sailing Club. All liabilities in connection with the club’s operations or actions shall be borne by Vikings Sailing Club as a legal entity.

Termination

1. The club reserves the right to terminate a member’s membership for misconduct or breach of these terms. Such a decision is final.

Force Majeure

1. Vikings Sailing Club is not liable for failure to fulfill its obligations due to natural disasters, civil unrest, or other force majeure events.

Conduct and Behaviour

1. Members and sailors must act considerately. Unruly or dangerous behaviour will result in immediate expulsion without refund.

Merchandise and Returns

1. Merchandise purchased can be returned in accordance with applicable Maltese laws on consumer rights.

Membership

1. Membership fees are non-refundable under any circumstances.

Storage of Boats and Third-Party Property

1. Boats and other third-party property stored at Vikings Sailing Club are done so at the owner’s risk. The club will not be held liable for any loss, damage, or theft of property stored on the premises.

Updates to Terms

1. These Terms and Conditions may be updated or revised at the committee’s discretion. Notification of changes will be provided to members.

Links to Other Websites

1. This website may contain links to third-party websites. Vikings Sailing Club is not responsible for the content on these external sites.

Waiver

1. Failure by Vikings Sailing Club to enforce any provision of these terms will not be considered a waiver of such provision or the right to enforce it.
